Even though a liberal jury let Jose Ines Garcia Zarate walk, in the murder of Kate Steinle, he may not be completely off the hook. A federal grand jury issued an indictment against Zarate.
Mercury News outlines the story:
The defendant accused of shooting Kate Steinle is facing new federal charges, just days after being acquitted of murder in a closely-watched trial.
A federal grand jury indicted Jose Ines Garcia Zarate on Tuesday for being a felon in possession of a firearm and ammunition and being an “illegally present alien” in possession of a firearm and ammunition, federal prosecutors announced in a statementTuesday evening.
The allegations mirror the lower charge Garcia Zarate was convicted of in state court. After a four-week trial, 12 jurors found Garcia Zarate not guilty on Thursday of first- or second-degree murder, involuntary manslaughter or assault with a deadly weapon but convicted him of being a felon in possession of a firearm.
If convicted of either federal charge, Garcia Zarate could face a maximum penalty of 10 years in federal prison. He is scheduled to be sentenced next week for his conviction in state court, where he faces up to three years but has already served more than two years.
Let’s hope the Steinle family finally sees some justice in the atrocious murder of their beloved Kate.
