When it comes to the Deep State, two names spring to mind immediately. Former CIA director John Brennan and former director of National Intelligence James Clapper.
For the better part of the last three years, these two men have been paid by liberal media outlets to offer their supposed expertise in analyzing the fake Russia conspiracy.
In the course of doing so, many people suspect that they have been the sources of numerous leaks to the media. Now we need an investigation of both of these men, and if they did this, they must be prosecuted.
Angelo Codevilla writes at American Greatness:
Why Are Clapper and Brennan Not in Jail?
The clearest of all the laws concerning U.S. intelligence is Section 798, 18 U.S. Code—widely known in the Intelligence Community as “the Comint Statute,” or “the 10 and 10.” Unlike other laws, this is a “simple liability” law. Motivation, context, identity, matter not at all. You violate it, you are guilty and are punished accordingly.
Here it is:
a) Whoever knowingly and willfully communicates, furnishes, transmits, or otherwise makes available to an unauthorized person, . . . any classified information—
(1) concerning the nature, preparation, or use of any code, cipher, or cryptographic system of the United States or any foreign government; or
(2) concerning the design, construction, use, maintenance, or repair of any device, apparatus, or appliance used or prepared or planned for use by the United States …or
(3) concerning the communication intelligence activities of the United States or any foreign government; or
(4) obtained by the processes of communication intelligence . . .
Shall be fined under this title or imprisoned not more than ten years, or both.
Codevilla then cites examples of leaks which were provided to the New York Times and the Washington Post.
Consequently, there is no clearer indictment of our legal system than the fact that no one has been prosecuted for these violations, much less punished.
Nor is there any doubt as to who at least two of these “senior intelligence officials” are: Former CIA director John Brennan and former Director of National Intelligence James Clapper.
Codevilla goes on to suggest that Brennan and Clapper have escaped consequences because they are deeply connected to the permanent government class in Washington, DC.
He is probably correct on that point but it doesn’t change the facts.
These men have done real harm to the country in the name of partisan politics. They should not be allowed to avoid punishment simply because they know the right people.
